# Terms of Service
These Terms of Service (the "Terms") set forth the conditions for using the PhotoKip mobile application and related services (the "Service") provided by **ConnectionValue Inc.** (the "Company"), and the rights, obligations, and responsibilities between the Company and users.
By installing or using the Service, you are deemed to agree to these Terms. If you do not agree to these Terms, you must not use the Service.

## 1. Purpose
The purpose of these Terms is to define the basic conditions that apply when users use PhotoKip to store and organize informational photos, videos, descriptions, memos, categories, and related data on their own devices.

## 2. Definitions
The terms used in these Terms have the following meanings.

| Premium | A set of paid features provided by the Company |
| Premium Lifetime Access | An in-app purchase product that allows access to Premium features with a one-time payment and no recurring payment |
| App Marketplace | An app distribution platform such as the Apple App Store or Google Play Store |

## 3. Effect and Changes to These Terms
1. These Terms become effective when posted in the Service, on an App Marketplace, on a webpage designated by the Company, or by another appropriate method.
2. The Company may change these Terms within the scope permitted by applicable laws.
3. If the Company changes these Terms, it will notify Users of the changes and effective date in advance by reasonable means, such as an in-app notice, app update notice, or webpage posting. However, changes that are not disadvantageous to Users or urgent changes required by laws or policies may be notified after they take effect.
4. If a User continues to use the Service after the effective date of the changed Terms, the User will be deemed to have agreed to the changed Terms.
5. If a User does not agree to the changed Terms, the User may stop using the Service and uninstall the app.

## 4. Service Description
PhotoKip is a personal photo wallet app for organizing informational photos and videos that users need to find again, such as work photos, health-related materials, document screenshots, receipts, daily-life information, and product labels, separately from the default gallery.
The main features of the Service include:
1. Saving photos and videos captured with the camera or selected from the gallery
2. Organizing media with collections, categories, colors, titles, descriptions, and memos
3. Viewing features such as search, sorting, bookmarks, full-screen viewing, and zoom
4. Media management features explicitly performed by the User, such as saving to the device gallery, sharing, and choosing whether to delete originals
5. Operational features such as advertising, push notifications, app stability improvements, Premium purchase, and purchase restoration
The Company may change or discontinue all or part of the Service for quality improvement, policy changes, security needs, or operational needs. If a change or discontinuation has a material impact on Users, the Company will provide prior notice by reasonable means.

## 5. No Account and Local Storage Principle
1. The Service can be used without account registration or login.
2. Content stored by Users in the Service is, in principle, stored only in the internal storage of the User's device and is not uploaded to the Company's servers.
3. The Company cannot access or restore Content stored on the User's device.
4. If a User uninstalls the app, loses or resets the device, or data is damaged due to an operating system or storage issue, Content stored on the device may be permanently deleted.
5. The Service currently does not provide Company-server cloud backup, account-based synchronization, or device-to-device data transfer. Users are responsible for separately preserving important Content.

## 6. Device Permissions and Third-Party Services
The following permissions or third-party services may be used to provide the Service.

| OneSignal | Sending push notifications |
| RevenueCat | Verifying in-app purchase status and restoring purchases |
| Coupang Partners | Displaying affiliate ads or referral links |

## 7. Free Service and Premium Lifetime Access
1. Free Users may use the Service within the scope set by the Company. The current main limitations for Free Users are as follows.

2. The Company may change the scope of free features and the details of Premium features due to service operations, costs, feature improvements, App Marketplace policies, or changes in applicable laws. Material changes affecting Users will be notified by reasonable means.
3. Premium Lifetime Access is a one-time in-app purchase that allows Users to access Premium features without recurring payment and to restore the purchase using the same App Marketplace account.
4. "Lifetime access" means access to Premium features through the applicable purchase account while the Service is normally provided. It does not mean that the Company guarantees permanent operation of the Service or unconditional provision of all future features.
5. If a User changes devices, reinstalls the app, or the purchase status is not reflected correctly, the User may use the "Restore Purchases" feature in the app. Purchase restoration is processed based on the App Marketplace account, the App Marketplace's purchase records, and purchase status verification through RevenueCat.
6. Premium purchase records are linked to the User's App Marketplace account and may not be transferable to another App Marketplace, another account, or another platform.

## 8. Payment, Withdrawal, and Refunds
1. Payment for Premium Lifetime Access is processed through the in-app purchase system of the App Marketplace used by the User.
2. The purchase price, payment method, taxes, receipts, purchase approval, refund eligibility, and refund procedure are governed by the policies of the App Marketplace where the purchase was made and applicable laws.
3. Purchases made through the Apple App Store are handled according to Apple's refund process.
4. Purchases made through the Google Play Store are handled according to Google Play's refund process.
5. For in-app purchases where the Company does not directly collect payment, the Company cannot arbitrarily change the payment or refund review results of the App Marketplace.
6. These Terms do not limit any withdrawal, refund, or consumer rights recognized under applicable laws.

## 9. Ads and Affiliate Links
1. Free Users may see ads while using the Service, including banner ads, interstitial ads, and native ads.
2. The Service may include ads or affiliate links. If a User moves to an external website or app through such links, the terms and privacy policy of that external service will apply.
3. The Service may receive commissions through affiliate programs such as Coupang Partners.
4. The Company will make efforts to disclose ads or affiliate relationships in accordance with applicable laws and platform policies.
5. Ads inside the Service are removed for Premium Users. However, this may not apply to notices or displays in areas not directly controlled by the Company, such as App Marketplaces, operating systems, or external sharing screens.

## 10. User Content and Responsibilities
1. Rights to Content stored by Users in the Service remain with the Users.
2. The Company does not view, collect, upload, sell, or provide to third parties Content stored by Users on their devices. However, if a User directly sends Content to an external app or a third party through a sharing feature or similar action, the policies of that external service will apply.
3. Users must have the rights and permissions necessary for the Content they store, manage, or share.
4. Users must not store, manage, share, or otherwise use the following Content in connection with the Service.
1. Content that infringes another person's copyright, portrait rights, personal information, trade secrets, or other rights
2. Content that violates laws, public order, or good morals
3. Content used for crimes, illegal acts, fraud, spam, or distribution of malicious code
4. Content that interferes with the operation of the Company or a third party's service or compromises security
5. The fact that Content is stored locally does not exempt Users from legal responsibility.

## 11. User Obligations and Prohibited Acts
Users must not do any of the following while using the Service.
1. Use the Service in violation of applicable laws, these Terms, or App Marketplace policies
2. Interfere with the normal operation of the Service or cause excessive load
3. Reverse engineer, decompile, modify, or bypass security features of the app
4. Bypass technical measures related to paid features, ads, purchase verification, or access restrictions
5. Infringe the rights or interests of the Company, third parties, or other Users
6. Cause harm to others by using false information, malicious code, illegal Content, or infringing Content
7. Copy, distribute, lease, sell, or provide the Service as a separate service for commercial purposes without the Company's prior consent

## 12. Intellectual Property
1. Intellectual property rights in the Service name, logo, screen composition, software, design, text, database structure, and other materials provided by the Company belong to the Company or the rightful owners.
2. Users may use the Service under these Terms on a personal, non-exclusive, and non-transferable basis.
3. These Terms must not be interpreted as transferring or assigning any intellectual property rights in the Service or the Company to Users.

## 13. Service Suspension and Use Restrictions
The Company may temporarily suspend or restrict all or part of the Service in the following cases.
1. Failure of external services such as servers, networks, App Marketplaces, external SDKs, or payment systems
2. Security incidents, error fixes, updates, maintenance, or other technical measures
3. Compliance with applicable laws, App Marketplace policies, or requests from administrative or judicial authorities
4. A User's violation of these Terms or interference with Service operations
5. Force majeure events such as natural disasters, power outages, communication failures, war, terrorism, epidemics, or similar events
If a restriction or suspension has a material impact on Users, the Company will provide prior notice where reasonably possible. However, notice may be provided after the fact if the situation is urgent or prior notice is difficult.

## 14. Disclaimer of Warranties
1. The Company makes reasonable efforts to provide the Service reliably.
2. However, the Service may be affected by the User's device condition, operating system version, storage space, permission settings, network status, and the status of App Marketplaces and external services.
3. To the extent permitted by applicable laws, the Company does not warrant the following.
1. That the Service will operate identically on all devices or all operating system versions
2. That the Service will always be provided without interruption, errors, delays, or data damage
3. That Content stored by Users will always be preserved regardless of app deletion, device loss, insufficient storage, operating system errors, permission changes, or similar circumstances
4. That third-party services such as external ads, App Marketplaces, payment systems, push notifications, or analytics tools will always operate normally

## 15. Damages and Limitation of Liability
1. If the Company or a User violates these Terms or applicable laws and causes damage to the other party, the party at fault will be liable for damages in accordance with applicable laws.
2. The Company is not liable for the following damages unless caused by the Company's intent or negligence.
1. Loss of local data caused by the User's app deletion, device loss, device change, device reset, insufficient storage, operating system errors, or permission settings
2. Damage caused by Content deletion, original deletion, sharing, or transfer to external apps directly performed by the User
3. Damage caused by failures or policy changes of third-party services such as App Marketplaces, payment systems, ad networks, push notifications, or analytics tools
4. Damage caused by force majeure events such as natural disasters, communication failures, war, terrorism, epidemics, or actions by administrative or judicial authorities
3. This section does not apply where the Company's liability cannot be excluded or limited under applicable laws.

## 16. Privacy
The Company processes Users' personal information in accordance with applicable laws and the Privacy Policy. Please refer to the Privacy Policy for details regarding collection, use, retention, third-party services, advertising, and Users' rights.

## 17. Interpretation and Governing Law
1. Matters not specified in these Terms are governed by applicable laws of the Republic of Korea, App Marketplace policies, and general commercial practices.
2. These Terms are interpreted in accordance with the laws of the Republic of Korea.
3. If a dispute arises between the Company and a User in connection with the Service, the Company and the User will make good-faith efforts to resolve the dispute through consultation.
4. If a dispute cannot be resolved through consultation, the competent court will be determined in accordance with applicable laws, including the Civil Procedure Act.
